ASCAP and Music Choice Enter Into An Agreement On Music Performing Rights Fees

The American Society of Composers, Authors & Publishers (ASCAP) and Music Choice have entered into a long-term agreement concerning the music performing rights fees for the MUSIC CHOICE(R) digital music service.

Music Choice is the largest provider of commercial-free digital music via cable and satellite. The agreement covers distribution of the MUSIC CHOICE(R) service in the home via cable, satellite and other media such as the Internet.

John A. LoFrumento, CEO of ASCAP, noted that "this agreement recognizes that Music Choice values the contribution made by ASCAP members and it assures that these members will be adequately compensated for the performance of their copyrighted musical works."

Del Beccaro, president and CEO of Music Choice, said that "Music Choice is pleased to have reached a mutually satisfactory agreement which affirms the notion of fairness and competition within the music service industry while respecting the rights of copyright holders."

This agreement concludes Music Choice's participation in the cable-wide proceeding regarding ASCAP license fees.
