New York Man Targets Live Nation With Class Action Suit Over Fees


NEW YORK (CelebrityAccess) — A Long Island man has hit Live Nation with a class action lawsuit, alleging that the company is falsely advertising prices for concert tickets at the Jones Beach Theater.

According to the New York Daily News, David Himber filed the suit after he attempted to purchase tickets a Rascal Flatts concert on Sept. 1. Himber claims tickets to the show were advertised at $49.50, but when he attempted to purchase tickets at the venue box office, he was hit with a surcharge that upped the price to $55.50 per ticket.

"The advertised price is available to nobody," said Himber's lawyer Abraham Kleinman, according to the Daily News.

Himber filed the suit on behalf of what he estimates are more than 60,000 concert-goers per year who are disadvantaged by the alleged false advertising.

According to the Daily News, Himber has filed three other lawsuits in Long Island Federal Court, but his attorney maintains that Himber is not overly litigious.

Carrie Davis, a spokeswoman for Live Nation, declined to comment to the Daily News. – Staff Writers
