CHICAGO (CelebrityAccess MediaWire) — Judge Vincent Gaughan of Cook County is holding a pretrial hearing to determine whether or not he will allow the prosecution to call a doctor to the stand in order to determine the age of the female in the R. Kelly sex tape.
Prosecutors wanted a pediatrician to provide expert testimony that the woman on the tape was not of legal age for consensual sex. Kelly’s defense team argued that the age of the alleged victim should be left up to the jury and any estimation from the doctor would subjective.
The prosecution confidently told the Chicago Tribune that even should the pretrial hearing go against them and the defense is successful in blocking their expert witness, they will have enough evidence to make a successful case.
