Germain Amphitheater Too Loud For Neighboring Town


COLUMBUS, OH (CelebrityAccess MediaWire) — The city of Westerville, OH, is bringing in expert testimony in order to prove that nearby Germain Amphitheater – located in Colubus, OH – was in violation of the noise ordinance eleven times in 2001 and 2002.

An agreement between the cities of Columbus and Westerville allows the latter city to enforce its noise ordinance on the Germain Amphitheater, despite the fact that the venue is located in Columbus, not Westerville.

While the bench trial has been postponed until March 7 at the request of the defense, expert testimony was heard last week in order to help the prosecution prove that at least five times in 2003 and 2004 the venue again broke the ordinance. Steve Pflaum, a lawyer for Westerville, said the testimony would assist the judge in understanding how violations are proven. –by CelebrityAccess Staff Writers
