Survivor Miffed The Kentucky Clerk Used 'Eye Of The Tiger' At Rally

CHICAGO (CelebrityAccess) — Members of Survivor have threatened embattled Kentucky county clerk Kim Davis with legal action over her use of their hit song "Survivor" during a rally after she was released from jail.

Davis was jailed for contempt of court after she refused to issue marriage licenses to same-sex couples when ordered to do so by the courts. She spent a few days in jail and upon being released on Tuesday, attended a rally with Republican presidential candidate Mike Huckabee.

In a statement released to Billboard, songwriter and founding member of Survivor wrote:

"I was very surprised and dismayed at the misuse of the song I co-wrote with Frankie Sullivan for Rocky lll. The song has motivated thousands through the years to reach beyond their limits. Its use for the release of Kim Davis does not support my views or my politics. I have contacted my publishers to make sure this usage is stopped immediately."

Peterik's co-writer for the song, Frankie Sullivan also took pains to note that he did not support Davis' use of the song, tweeting: "We did not grant Kim Davis any rights to use 'My Tune -The Eye Of The Tiger.' I would not grant her the rights to use Charmin!" – Staff Writers
