Devo Sues McDonalds Over Happy Meal Toy

NEW YORK (CelebrityAccess MediaWire) — New Wave icons Devo have filed suit against fast food mavens McDonald's over an American Idol Happy Meal toy that the band contends are a rip-off of their trademark look and sound.

The toy in question is called New Wave Nigel and features a fellow dressed in an orange jumpsuit with a Devo-like orange flowerpot hat and stylized sunglasses. To compound matters, the band asserts that the toy also plays a "devoesque song."

"We are in the midst of suing them," Casale told AAP.

"This New Wave Nigel doll that they've created is just a complete Devo rip-off and the red hat is exactly the red hat that I designed, and it's copyrighted and trademarked.

"They didn't ask us anything. Plus, we don't like McDonald's, and we don't like American Idol, so we're doubly offended."

The toy is part of an American Idol promotional effort by the fast food giant that also include Disco Dave, Country Clay, Rockin' Riley and Soulful Selma. – CelebrityAccess Staff Writers
